## Quick answer

Proportionate responsibility is Texas's name for its comparative fault system. The jury assigns each party a percentage of responsibility. Your damages are reduced by your own share, and you recover nothing if your share is 51% or more.

## In a car accident claim

Texas uses a modified comparative fault rule with a 51% bar, set out in Tex. Civ. Prac. & Rem. Code §§ 33.001, 33.012(a). At 50% or less, you can recover, minus your percentage. At 51% or more, you recover nothing from the other drivers.

Insurers apply the same rule when they negotiate, long before any jury is involved. An adjuster who says you were 30% at fault is offering to pay, at most, 70% of what it accepts as your damages. That is why small facts about who did what, such as speed, signals, lane position and phone use, can matter so much. Evidence like the crash report, photos, video and witness statements often decides the split.

The [Texas guide](https://accidentclaimfacts.com/location/texas/) covers insurance minimums, deadlines and damage caps, and the [fault-rule explainer](https://accidentclaimfacts.com/tools/fault-rule-explainer/?state=tx&fault=20#fault) shows the math for any percentage.

## Example

> **Example:** A Houston driver turning left collides with a speeding car. The jury finds the turning driver 30% responsible and the speeding driver 70%. The turning driver's damages are reduced by 30%. Had the jury found them 60% responsible, they would recover nothing.

## FAQ

### Is proportionate responsibility the same as comparative negligence?

In substance, yes. It is Texas's version of modified comparative fault with a 51% bar: you can recover if you were 50% or less responsible, reduced by your share.

### What happens at exactly 50% responsibility in Texas?

You can still recover, but your damages are cut in half. The bar applies only when your share is more than 50%.
