## Quick answer

Small claims court is a simpler court, or a division of a court, for money disputes below a dollar limit set by state law. Forms are short, hearings are informal, the rules of evidence are relaxed, and most people speak for themselves. A judgment there is as binding as one from any other trial court.

## In a car accident claim

Small claims court can fit a crash claim when the amount is modest, for example a repair bill or deductible the other driver's insurer refuses to pay, or a minor injury claim with clear fault. Limits vary widely. In California, an individual can sue for up to $12,500, and you can ask a lawyer for advice before court, but a lawyer cannot appear with you in court. In Texas, small claims cases go to justice court, which can hear civil cases up to $20,000.

The trade-off is the cap. If your losses are larger, suing in small claims court usually means giving up the amount above the limit, so it fits property damage and small, healed injuries best. ## Example

> **Example:** After a parking-lot crash, the at-fault driver's insurer denies the claim, saying fault is unclear. The damaged car's repair bill is well under the state's small claims limit. Its owner files in small claims court, brings photos and the repair estimate, and a judge decides the case at a short hearing.

## FAQ

### Does winning in small claims court mean you get paid?

Not automatically. A judgment says how much is owed; collecting it is a separate step. The winning side can use the same enforcement tools as in any other court, and state courts' self-help pages explain them.

### Does the deadline to sue still apply in small claims court?

Yes. The statute of limitations applies to small claims cases too, so the case must be filed before the state's deadline.
